Policy before contacting the Artist!
The
Artist will gladly discuss licensing agreement options for use
of the works for
various products, projects, or organizations, so please contact
her at the email address listed in this Policy. Thank you for
your consideration and respect of the Artist's work and
livelihood.
A. GENERAL USE
Permission requests to use works created by Dawn Schmidt
Ventimiglia of Eclectic Dawn Arts should be directed to the
Artist by e-mail at dawn(at)eclecticdawnarts(dot)com.
Provided that you have received written permission from
the Artist, non-compensatory use is limited to non-commercial,
private use, or for educational purposes, provided that
a
credit line shall include the phrase: “Courtesy of Artist, Dawn
Schmidt Ventimiglia, EclecticDawnArts.com." If you wish to use
different wording in the credit line, please contact the Artist.
Uses by institutions should be limited to one-time educational
purposes only. Contact the artist for permission BEFORE
using any images or content created by the artist.
B. USE OF ORIGINAL ART IMAGES OR CONTENT
1. Private
and Educational One-time Uses
These are original works by the Artist, Dawn Schmidt Ventimiglia,
who retains any and all copyright for any and all use, and all
rights are reserved. Permission to use these images in part or
in their entirety for any purpose MUST be obtained from the
Artist before images are used.
Credit lines for printed educational use of these images should
include the phrase: “Courtesy of Artist, Dawn Schmidt
Ventimiglia, EclecticDawnArts.com."
2. Saleable Item Use
Reproduction of art work in any form for
sale must be approved in writing by the Artist or her heirs who
retain copyright. Contact Dawn Schmidt Ventimiglia for
permission to use any images, in part or in their entirety.
Artist will be compensated per an agreement between purchaser of
Saleable Item Use and the Artist.
a.
Publication Illustrations
Where an art work will be used for a book cover or inside
illustration to accompany educational material or to aid in the
sale of such material, approval in writing must be obtained from
the Artist or her heirs.
These situations are usually approved with the following
requirements:
(1) A nominal courtesy fee
(2) Copies of the final book or other item supplied to the
Artist or heirs
(3) Proof approval by Artist or heirs when possible
(4) Credit line for Artist
(5) One time use agreement
(6) Safe return of original transparency, prints, or digital
files
b. Misc.
Saleable Items
When the art work in any form is used to aid in the sale of
items or materials, approval in writing must be obtained from
the Artist or her heirs. Examples include, but are not limited
to: henna tattoos, permanent tattoos, murals, posters, prints,
book covers, coffee mugs, T-shirts, puzzles, hats, greeting
cards, magnets, postcards, or any other item produced for sale
by any group or individual.
These situations are usually
approved with the following requirements:
(1) A licensing fee per item TBD through negotiation of both
parties,
or a sale in toto of image rights to the entity producing
items for sale
(2) One or more item(s) or photo of item(s) on which the image
is produced will be supplied to the
Artist
or heirs
(3) Proof approval by
Artist
or heirs when applicable
(4) Credit line for
Artist,
whether or not rights have been transferred
(5) Specific use agreement in writing, signed by both parties
(6) Safe return of original transparency, prints, or digital
files
